Terms of Service and Privacy Policy
PART A: TERMS OF SERVICE
Last updated: 5-October-2026
1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your use of the website [https://acemotoren.com/] (“Website”) and the services offered by [registered entity name], trading as ACE Motoren, having its office at 5th Floor, 505, Horizon Tower, Jewel Of India, JLN Marg, Jaipur, Rajasthan 302017, India (“ACE Motoren”, “we”, “us”, “our”).
By accessing the Website, submitting an enquiry, or engaging our services, you agree to these Terms, our Disclaimer and our Privacy Policy. If you do not agree, please do not use the Website or our services. These Terms are an electronic record under the Information Technology Act, 2000 and do not require physical or digital signatures.
2. Definitions
- “Client” means any individual or entity that engages ACE Motoren for services.
- “Services” means the consultancy, sourcing, sales, facilitation and related services described in clause 4.
- “Engagement Agreement” means a written agreement, quotation, proforma or booking confirmation signed or accepted by the Client and ACE Motoren for specific Services.
- “Third-Party Provider” means any dealer, manufacturer, importer, bank, NBFC, insurer, applicator, logistics provider, authority or other party not owned by ACE Motoren.
3. Eligibility
You must be at least 18 years old and legally competent to contract under the Indian Contract Act, 1872. If you act for a company, firm or trust, you confirm you are authorised to bind it.
4. Our Services
ACE Motoren provides curated advisory and coordination services for luxury automotive clients, which may include:
- New luxury vehicle buying advisory, acquisition consulting and allocation guidance;
- Pre-owned vehicle selling support, including valuation, listing and sale, directly or on behalf of the owner;
- Paint Protection Film (PPF), ceramic coating and detailing services;
- Advisory and facilitation for auto finance and insurance;
- Service and maintenance assistance and consultation;
- Vehicle registration, transfer and documentation support;
- Delivery coordination; and
- End-to-end consultation across the overall purchase journey.
The scope, fees and timelines of each service are set out in the relevant Engagement Agreement. Where these Terms conflict with an Engagement Agreement, the Engagement Agreement prevails for that engagement.
5. Nature of Our Role
- For new vehicles, ACE Motoren acts as a consultant and facilitator. Unless the Engagement Agreement says otherwise, the sale contract is between the Client and the dealer or manufacturer, and their terms apply.
- For pre-owned vehicles that ACE Motoren sells directly, ACE Motoren acts as seller or as agent of the owner, as stated in the Engagement Agreement or invoice.
- Nothing in these Terms creates a partnership, joint venture, employment or fiduciary relationship, except as expressly agreed in writing.
6. Engagement Process
- An enquiry or consultation does not bind either party.
- A binding engagement arises only when the Client signs or accepts an Engagement Agreement and pays any advance or fee due under it.
- ACE Motoren may decline or discontinue any engagement at its discretion, including where verification, compliance or ethical concerns arise, subject to refund of unutilised amounts as per clause 9.
7. Client Responsibilities
The Client agrees to:
- Provide accurate, complete and lawful information and documents, including identity, address, KYC, income and ownership documents;
- Respond promptly to requests so that timelines can be met;
- Make payments on time and through legitimate banking channels;
- Inspect vehicles, documents and work done, and report concerns promptly in writing;
- Comply with all laws applicable to the purchase, ownership, finance, insurance and use of the vehicle.
ACE Motoren may rely on the information provided by the Client without independent verification, except where our engagement expressly includes verification.
8. Compliance, KYC and Anti-Money-Laundering
ACE Motoren and Third-Party Providers may require KYC and source-of-funds information under applicable law, including the Prevention of Money-laundering Act, 2002 and related rules. We may refuse or suspend a transaction if information is incomplete, inconsistent or suspicious, and we may report to authorities where the law requires. Cash dealings above limits permitted by law are not accepted.
9. Fees, Payments, Cancellation and Refunds
- Fees. Consultancy, facilitation and service fees are stated in the Engagement Agreement or quotation. Unless stated otherwise, they are exclusive of GST and other applicable taxes.
- Advance and booking amounts. Booking, token or advance amounts secure allocation, a vehicle or a service slot, and are applied to the final amount due.
- Consultancy fees. Fees for work already performed (research, sourcing, negotiation, inspections, documentation) are non-refundable to the extent the work was done.
- Amounts paid to Third-Party Providers. Refunds of amounts paid to dealers, manufacturers, insurers, banks or authorities are governed by their policies. ACE Motoren will assist in good faith but cannot guarantee a refund.
- Pre-owned vehicles. Sold “as is, where is” unless a written warranty is issued. Cancellation after confirmation is subject to the booking terms in the invoice or agreement.
10. Pricing, Availability and Timelines
Prices, taxes, duties, allocation, waiting periods, offers and delivery dates are controlled largely by manufacturers, dealers and government policy. All figures on the Website or in conversations are indicative until confirmed in writing. We do not guarantee any date or allocation unless stated in the Engagement Agreement.
11. Finance and Insurance
Financing and insurance are provided only by regulated lenders and insurers, subject to their eligibility, approval and terms. ACE Motoren does not guarantee approval, interest rates, premiums or claim settlement. The Client’s contract for finance or insurance is directly with the provider.
12. Registration and Documentation
Registration, transfer, permits, number allotment and related approvals are decided by the relevant Regional Transport Office or authority under the Motor Vehicles Act, 1988 and related rules. ACE Motoren assists with filing and follow-up but does not control outcomes or timelines. Statutory fees and taxes are borne by the Client.
13. PPF, Detailing and Add-On Services
Service outcomes depend on the vehicle’s condition, the products used and subsequent care. Warranties on films, coatings and products are provided by their manufacturers or applicators on their terms. Warranty is void if the Client or a third party tampers with or improperly maintains the treated surface. Minor cosmetic variation is not a defect.
14. Delivery
Delivery is coordinated with the dealer or seller. Risk in the vehicle passes as per the sale contract. The Client must inspect the vehicle and documents at delivery and note discrepancies in the delivery acknowledgement. Transit, storage and logistics are subject to the terms of the relevant provider.
15. Third-Party Providers
We select Third-Party Providers with reasonable care but do not control them. ACE Motoren is not responsible for their acts, omissions, products, pricing, delays or insolvency. Claims regarding their goods or services must be made against them, and ACE Motoren will reasonably assist the Client in doing so.
16. Confidentiality
ACE Motoren will keep Client information confidential and use it only to deliver the Services, except where disclosure is required to Third-Party Providers for the transaction, to professional advisers under confidentiality duties, or under law. The Client agrees to keep ACE Motoren’s pricing, commercial terms and proprietary methods confidential.
17. Intellectual Property
All content on the Website, including text, graphics, logos, design, photographs and software, belongs to ACE Motoren or its licensors and is protected by Indian intellectual property laws. Vehicle brand names and logos belong to their owners, and their use does not imply endorsement or affiliation. You may view the Website for personal use but may not copy, scrape, reproduce, modify or commercially exploit it without written permission.
18. Acceptable Use of the Website
You agree not to:
- Provide false or misleading information or impersonate any person;
- Use the Website for unlawful, fraudulent or defamatory purposes;
- Introduce malware, probe vulnerabilities, or interfere with the Website’s operation;
- Use bots or scrapers to extract data without permission;
- Infringe the rights of ACE Motoren or any third party.
We may suspend or block access for breach of this clause.
19. Communications Consent
By sharing your contact details, you agree that ACE Motoren may contact you by phone, SMS, email and messaging apps (including WhatsApp) about your enquiry, services and related updates. You can opt out of marketing communications at any time by writing to us or using the opt-out link. Service and transactional messages may continue while an engagement is active.
20. Disclaimer of Warranties
The Website and its content are provided “as is” and “as available”. Subject to law, we disclaim implied warranties of accuracy, completeness, fitness for a particular purpose and uninterrupted availability. Please read our Disclaimer, which forms part of these Terms.
21. Limitation of Liability
- To the extent permitted by law, ACE Motoren is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or loss of use.
- ACE Motoren’s total liability arising from any engagement is limited to the fees actually received by ACE Motoren for that engagement [edit as agreed].
- Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under law, including rights under the Consumer Protection Act, 2019.
22. Indemnity
The Client shall indemnify ACE Motoren against losses, claims and reasonable costs arising from the Client’s breach of these Terms, false or forged documents or information, unlawful use of the vehicle, or violation of any law.
23. Force Majeure
ACE Motoren is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, pandemics, strikes, government orders or policy changes, supply disruptions, manufacturer or dealer actions, and failures of banking, power or internet systems.
24. Suspension and Termination
Either party may terminate an engagement by written notice as per the Engagement Agreement. ACE Motoren may suspend or terminate immediately for non-payment, breach, suspected fraud or legal non-compliance. Clauses that by nature should survive termination (including payment, confidentiality, liability, indemnity and governing law) will survive.
25. Governing Law, Dispute Resolution and Jurisdiction
- These Terms are governed by the laws of India.
- The parties will first try to resolve disputes through good-faith discussion for [30] days.
- Unresolved disputes will be referred to arbitration by a sole arbitrator appointed by mutual consent, under the Arbitration and Conciliation Act, 1996. The seat and venue will be Jaipur, and the language will be English.
- Subject to the above, courts at Jaipur, Rajasthan have exclusive jurisdiction.
- Nothing here prevents a consumer from approaching a Consumer Commission where the law permits.
26. General
- Entire agreement: These Terms, the Disclaimer, the Privacy Policy and any Engagement Agreement form the whole agreement on their subject.
- Severability: If any clause is held invalid, the rest remains in force.
- Waiver: Failure to enforce a right is not a waiver of it.
- Assignment: The Client may not assign rights without our written consent.
- Notices: Notices to ACE Motoren must be sent to acemotorenindia@gmail.com and 5th Floor, 505, Horizon Tower, Jewel Of India, JLN Marg, Jaipur, Rajasthan 302017, India. Notices to the Client may be sent to the contact details they provided.
- Changes: We may update these Terms. The updated version applies from its posting date, and continued use means acceptance.
